Notice to Employees of Marketplace (Exchange) Coverage Options
On May 8th, the U.S. Department of Labor(DOL) issued Technical Release 2013-02 to provide guidance to employers regarding a new requirement ― created by Section 1512 of the Affordable Care Act (ACA) ― that employers provide a notice to employees of coverage options available through the Health Insurance Marketplace (aka "Exchange") by October 1, 2013. Departments Release FAQ Guidance on SBC Requirement, other ACA Implementation Issues
On April 23, 2013 and April 29, 2013, the U.S. Departments of Labor, Health and Human Services, and Treasury (the "Departments") released the fourteenth and fifteenth installments of their "Frequently Asked Questions" (FAQs) on issues related to the Affordable Care Act (ACA). The FAQs are intended to provide guidance and clarification for employers and others as they implement the ACA's various requirements.

Updated Correction Procedures for 401(k), 403(b) and Simple IRA Plans go into Effect

Retirement plans must comply with a myriad of requirements under the Internal Revenue Code ("Code") in order to remain tax-qualified. Plan sponsors, at times, have found it challenging to understand and stay compliant with all of these requirements. To assist plan sponsors, the Internal Revenue Service ("IRS") established the Employee Plans Compliance Resolution System ("EPCRS") that prescribes correction principles and methods that plan sponsors may rely upon as being reasonable and appropriate methods to correct certain errors that occur in the course of the plan's operation and/or with regard to plan documentation. On April 1, 2013, new procedures under the EPCRS, set out in the IRS's Revenue Procedure 2013-12, went into effect. Read Full Article »

I-9 Forms: Do's and Don'ts

Employers are required to complete and retain a Form I-9 (Employment Eligibility Verification) for all new hires. On March 8, 2013, the U.S. Citizenship and Immigration Services (USCIS) released a revised version of the I-9. Employers must begin using the new version by May 7, 2013. The updated I-9 provides employers with an opportunity to review their employment eligibility verification practices. ADP Announces New ADP National Employment Report SM
The new ADP report will measure monthly changes in franchise employment derived from ADP's actual transactional payroll data to help determine franchise employment trends. It will be issued each month by the ADP Research InstituteSM, a specialized group within ADP that provides insights around national, regional and franchise employment trends and workforce strategy. It will be produced in collaboration with Moody's Analytics. The first ADP National Franchise Report will be released on June 20, reporting May 2013 data.
